how can i get a small claims subpoena to have access to documents?
i filed a small claim to a guy i bought a car from, and i need a subpoena to get the deleted listing of the car that was posted on craig's list. craig's list cannot send me a copy of the deleted listing with a court ordered subpoena. how do i get it? do i have to go to like, drop-in court? or can the desk clerk give me one? can i fill it out online? how long does it take? does it cost money?
Depends on State law, but the general procedure will be the same. Basically you will write the subpoena yourself (A subpoena for documents is called a "subpoena duces tecum") and take it to the clerks window at small claims court, where the clerk will record it and stamp it. You then have it served on Craigslist. (That service will have to be performed in California at Craigslist registered address for receipt of service.) How service must be accomplished is also dependent on State law. "Most" States allow service by mail for small claims, but not all. You can't do the service yourself - in some States it can be done by any adult not involved in the case, in some it must be a deputy or registered process server.
Whether you can write the subpoena out in plain form or use a specific form depends on the State. In my State - California - the use of small-claims specific forms is mandatory. The form you'd need here is an SC-107, and you can fill one in online at any courts website, then print and sign it. In my State there is no fee for small claims subpoena's, but there may be in yours.
